Privacy Notice

Last updated 26 October 2026

The short version

  • I only collect what I need to coach you properly and run Zenith Fit.
  • Your health and progress information is only used to coach you, and only with your permission.
  • I never sell your data, and nothing you share is used to train AI.
  • You can ask to see, change or delete your data at any time. Just email mark@zenithfit.co.uk.

Who I am

Zenith Fit is run by me, Richard Mark Davies (Mark), a sole trader based in Shrewsbury, Shropshire. I'm the data controller, which means I'm responsible for how your personal information is used.

Zenith Fit is registered with the Information Commissioner's Office (ICO). Registration number: ZC274939.

Any questions about your data, email me at mark@zenithfit.co.uk.

What I collect

Your contact details. Your name, email address and phone number.

Your health and progress information. Things like your weight, body measurements, progress photos, food logs, training, steps, sleep, mood, your weekly check ins, and any health conditions, injuries or medical history you tell me about. This is classed as special category data under UK GDPR, so it gets extra protection.

What you enter into Zenith HQ, your onboarding and the AI tools. Your HQ login, your answers and entries in the tools (like Rate Your Day, Weekend Game Plan and Goal Builder), your goal, the promise you sign during onboarding, and the videos and checklists you mark as done.

If you use my free tools or join the 14 Day Kickstart without being a client, I collect your name, email address and anything you choose to enter into the tools.

Website enquiries and referrals. If you use the contact form on my website, I collect your name, email address and your message. If you use the referral form, I collect your name, email address, phone number if you give it, who recommended you, which programme you're interested in, and what you'd like help with.

Your messages. Anything you send me through the Zenith Fit app, WhatsApp or email.

Payment information. Your payments are handled by Stripe. I can see what you've paid and when, but I never see or store your full card details.

Website information. When you visit zenithfit.co.uk, cookies and similar tools collect basic information about how you use the site. More on that below.

Almost everything I hold comes directly from you. Stripe tells me when a payment has gone through, and Meta tells me if you came to my site from one of my adverts.

Why I use it

The law asks me to have a lawful reason for using your data. Here are mine.

  • To deliver your coaching. Building your plan, reviewing your check ins, replying to your messages and giving you access to the app and Zenith HQ. This is necessary to provide the service you've signed up for.
  • To use your health information. I only do this with your explicit consent, which you give when you complete your welcome form, set up your Zenith HQ login, or tick the consent box on one of my tools. You can withdraw it at any time, although I won't be able to coach you properly without it. Giving me your health information isn't a legal requirement, but without it I can't build a safe, effective plan for you.
  • To reply to your enquiry or referral. When you send me a message or a referral through my website, I use your details to get back to you and answer your questions about coaching. This is a step you've asked me to take before possibly signing up, and it's in my legitimate interest to reply to people who get in touch.
  • To send you emails. If you sign up to the 14 Day Kickstart, a free resource or my emails, I'll send you emails about coaching and my programmes. Every email has an unsubscribe link. Sending me a message or referral through my website doesn't add you to my email list.
  • To run the business. Taking payments and keeping records for my accountant and HMRC (a legal requirement), plus keeping my systems secure and improving my service, which are my legitimate interests in running a safe, well run business.

Where your data is stored

I use trusted services to run Zenith Fit. Each one only gets the information it needs.

  • Everfit

The Zenith Fit coaching app. Your welcome form and PAR Q, programme, check ins, progress photos, food logs, measurements and messages.

  • Google

Google Drive, Sheets and Gmail. Your AI tool entries, onboarding answers, goal, coaching documents and emails, including the website enquiries and referrals forwarded to my inbox.

  • Cloudflare

Runs Zenith HQ. Stores your HQ login (your name, email and a scrambled password), your programme, your HQ entries such as your goal and Rate Your Day scores, and the promise you sign during onboarding. It also connects the AI tools to Anthropic.

  • Anthropic (Claude)

Powers the AI tools and helps me review check ins and draft your coaching feedback. Your information isn't used to train their AI.

  • GitHub

Hosts the Zenith HQ and AI tools pages. It doesn't store anything you enter.

  • Kit

My email system. Your name, your email address, and whether you've finished your onboarding.

  • Stripe

    Takes your payments securely.

  • Squarespace

    Runs my website.

  • Formspree

Handles the contact and referral forms on my website. It receives what you enter, keeps a copy, and forwards it to my email inbox. Formspree is based in the USA.

  • TidyCal

Books your monthly Transformation call, including the answers you give before the call.

  • WhatsApp and Blueticks

Messages and group updates. Blueticks lets me schedule messages. If you join a Zenith Fit WhatsApp group, other members may be able to see your name and number. Joining is always optional.

  • Pabbly Connect

Connects your payment to your welcome emails.

  • Loom

Personal video messages I record for you.

  • Meta

Facebook and Instagram advertising, using the Meta Pixel on my website.

  • My accountant and Xero

Payment and business records for tax.

Only I have access to your information. I never sell it or share it with anyone for their own use.

The AI tools

When you use one of my AI tools, what you type is sent securely to Anthropic to create your reply. A copy of your entry is saved so I can see how you're getting on and coach you off it.

Anthropic doesn't use your information to train its AI. The tools are there to support you between check ins. They're not medical advice, and anything medical should always go to your GP.

On your phone

Zenith HQ saves a few small things in your phone's browser so it works properly: that you're logged in, how far you've got through onboarding, and your name so you don't have to type it twice. They're needed for HQ to work, and clearing your browser removes them.

Automated decisions

I don't make any decisions about you using automated systems that have legal or similarly significant effects on you. The AI tools give you suggestions, but every coaching decision is made by me.

Data outside the UK

Some of these services are based in the USA, including Formspree, so your data may be stored there. When that happens it's protected by the safeguards UK law requires, such as the UK Extension to the EU US Data Privacy Framework or approved data transfer agreements.

How I keep it safe

Every account I use is protected with a strong password and 2 step verification, access is limited to me, and your Zenith HQ account is protected by your own login.

How long I keep it

  • Coaching and health information. Deleted 12 months after you leave Zenith Fit.
  • Payment and business records. Kept for 6 years, because HMRC requires it.
  • Free tool entries from non clients. Deleted after 12 months.
  • Website enquiries and referrals. Deleted after 12 months if they don't lead to coaching. If you go on to join, they're kept with your client information instead.
  • Email list. Kept until you unsubscribe.

Your rights

You have the right to:

  • see the data I hold about you
  • ask me to correct anything that's wrong
  • ask me to delete your data
  • ask me to limit how I use it, or object to me using it
  • get a copy of your data to take elsewhere
  • withdraw your consent at any time

Email mark@zenithfit.co.uk and I'll respond within 1 month. It's free.

If you're not happy with how I've handled your data, you can complain to the ICO at ico.org.uk or on 0303 123 1113. I'd appreciate the chance to sort it out with you first though.

Cookies

My website uses cookies to work properly and to understand how it's used. I also use the Meta Pixel to measure my Facebook and Instagram adverts, and some pages show YouTube and Vimeo videos, which can set their own cookies. Non essential cookies, including the Meta Pixel, only run if you accept them on the cookie banner. You can change your mind at any time, or block them in your browser settings.

Under 18s

Zenith Fit coaching is for adults aged 18 and over. I don't knowingly collect information from anyone under 18.

Changes to this notice

If anything changes in how I use your data, I'll update this page and the date at the top. If it's a big change, I'll let you know directly.
